The Legal Basis for Vehicle Repossession

Repossession is legal when a debtor has defaulted on a hire purchase, PCP, or conditional sale agreement. The creditor must hold a valid agreement under the Consumer Credit Act 1974.

There is one key rule to know. If the debtor has paid more than one third of the total amount, the creditor may need a court order before taking the vehicle from private land. We do not advise on whether a repossession is lawful. That is the job of the creditor or their solicitor. We act only on written instructions that confirm legal authority has been given.

How the Process Works

1. Written instructions: we take written instructions from the creditor or their representative. We need the vehicle details, keeper information, and last known location.
2. Verification: we confirm the vehicle matches the instruction before we touch it. We check the registration, make, model, and colour.
3. Recovery: we collect the vehicle on a flatbed truck. If the keeper is not present, we leave a written notice at the collection address.
4. Transport: the vehicle goes to the creditor's storage facility or our secure Salford yard.
5. Report: we issue a full written report. It covers time, date, vehicle condition, and collection address.

Discretion and Conduct

We work in plain, unmarked vehicles. We do not tell neighbours or bystanders why we are attending. We never use force. We never intimidate or harass anyone. We do not enter private land without permission unless a court order allows it.
